1. Introduction & Acceptance

These Terms of Service ("Terms") govern your access to and use of fincl (the "Service"), provided by fincl ("we," "us," or "our"). By uploading any documents or accessing our dashboard, you agree to be legally bound by these Terms.

If you do not agree to these Terms, do not use the Service.

2. Eligibility & Scope of Use

• Age Requirement: You must be at least 18 years old to use the Service.
• Personal Use Only: The Service is intended solely for personal financial tracking. You may not use it for commercial purposes (e.g., processing client data) without our prior written consent.
• Geographic Compliance: While the Service is accessible globally, you are responsible for ensuring your use complies with local laws in your jurisdiction.

3. User Obligations

To protect both yourself and the Service, you agree to the following strict usage guidelines:

• Mandatory Redaction: You acknowledge that you are solely responsible for redacting sensitive Personally Identifiable Information (PII) such as your full name, physical address, and full account numbers before uploading bank statements.
• Prohibited Content: You must not upload password-protected files, files containing illegal content, or data belonging to third parties without their explicit consent.
• Accuracy: You are solely responsible for the accuracy of the financial data you upload. We do not verify the authenticity of your documents.

4. AI & Automated Processing

• Nature of AI: The Service uses Artificial Intelligence (AI) and machine learning to extract and categorise data. You acknowledge that AI is probabilistic and may produce errors, hallucinations, or miscategorizations.
• No Reliance: You agree not to rely on the Service’s categorisation for tax filings, legal audits, or critical financial decisions. You must verify all data manually.
• No Financial Advice: The Service provides data visualization only. We are not financial advisors, planners, or tax professionals. Nothing in the dashboard constitutes financial advice, investment recommendations, or an offer to sell any financial product.

5. Data Handling & Retention

We prioritize your privacy through a "Zero-Retention" architecture. By using the Service, you acknowledge and agree to the following:

• Ephemeral Processing: We do not retain the raw files (PDFs/Images) of your bank statements. These files are processed in temporary memory and permanently deleted immediately after data extraction is complete.
• Data License: While you retain ownership of your content, you grant us a limited, worldwide, royalty-free license to process your data solely for the purpose of generating your dashboard.
• Anonymized Analytics: We may aggregate anonymized, non-identifiable data to improve our AI models (e.g., training the system to better recognize "Coffee" as a dining expense).

6. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."

We expressly disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be:

• Uninterrupted, secure, or error-free.
• Free from loss, corruption, or cyber-attacks.

7. Limitation of Liability

To the maximum extent permitted by law, fincl shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Financial Loss: Loss of profits, data, or goodwill.
• Tax Penalties: Any penalties or interest incurred due to reliance on our data categorisation.
• Data Breach: Damages arising from the interception of data during transmission.

Our total liability for any claim arising out of these Terms shall not exceed the amount you paid us (if any) in the past 12 months.

8. Dispute Resolution & Governing Law

• Governing Law: These Terms shall be governed by the laws of Singapore, without regard to conflict of law principles.
• Arbitration: Any dispute shall be resolved by binding arbitration in Singapore.

9. Termination

We reserve the right to suspend or terminate your access to the Service at any time, for any reason, without notice (e.g., if we suspect you are uploading malicious files). You may stop using the Service at any time.
